Limited
Warranty Exclusions-All OTR TYRES and Tubes
All OTR tyre and tube warranties are subject to the following exclusions:

Costs
of mounting and balancing following pro-rated replacement or repair of
tyre or tubes and applicable federal, state and local taxes, are not
covered by warrant
-
Tyre
damages or failures due to punctures, bruises, impact breaks, cuts,
cut separations, flex breaks, snags, tread tearing, or chunking are
not covered under this warranty.

Tyre
damages or failures due to improper inflation, misapplication,
overloading operation at excessive speed, running flat, chains or
studs, fire or other extreme temperature exposure are not covered
under this warranty.
-
Tyre
damages or failures caused by vehicle accidents, improper operation or
maintenance, brake, shock absorbers or similar mechanical problems,
misuse, negligence or abusive driving such as tyre spinning are not
covered under this warranty.

Tyre
damages or failures resulting from improper mounting, demounting,
handling, damage wheel and rim components, wheel misalignments,
improper storage tyre wheel assembly imbalance, mismatching of
adjacent tyres, chemical or petroleum damage, use of improper tube, of
improper tube, use of improper O-ring, use of non-approved rims broken
or kinked beads, intentional alteration of either the appearance or
physical characteristics of the tyre are not covered under this
warranty.

Tyre
age-age conditions, such as cracks, on tyres produced more than (2)
years prior to presentation for adjustment are considered not
adjustable.

Air
Retention –Claims for tyres being incapable of retaining air must be
presented within the first 5% of tread wear.
-
Claims
for irregular wear are not covered. Claims for short falls in
treadwear out are not covered by this Limited Warranty and Policy.
Because of variations in equipment conditions of use and driver
habits, it will not be warranted that any tyre will achieve
predetermined hours of service.

All
tube-type tyres should be used with proper size tubes.
-
Tyres
that have been repaired or retreaded are not covered under this
warranty.
-
Any
modifications to the tyre (added buttress shoulders, regrooving,
relugging etc) voids all warranties.
-
Any
material added to the tyre (tyre fill, sealants, internal balancing
medium, liquid ballast etc) is not covered by this warranty and will
not be compensated for in case of credit being issued for the tyre.
Use of a solid type fill, (such as urethane) voids all warranties.
-
Any
costs associated with the repair of tyres are not covered unless
previously approved by “FOREVER.”

All
OBLIGATIONS OR LIABILITIES FOR INCIDENTAL OR CONSEQUENTIAL DAMAGE ARE
HEREBY EXCLUDED, INCLUDING LOSS OF USE OF VEHICLE AND LOSS OF TIME
THEREMEDIES SET FORTH IN THIS LIMITED WARRANTY ARE THE REMEDIES SET
FORTH IN THIS LIMITED WARRANTY ARE TH ESOLE AND EXCLUSIVE REMEDIES FOR
BREACH OR WARRANTY.

NO
“FOEVER” dealer has the authority to make or imply any
representation. Promise or agreement which in any way varies of
extends the terms of this warranty.
TO OBTAIN WARRANTY
SERVICE
-
Contact
an authorized “FOREVER” ORT dealer. Please be prepared to provide
proof of purchase of the product and purchase date.

The
authorizes dealer will contact “FOREVER” to arrange for inspection
of the tyre in question and processing of your claim. The dealer has
no authority or responsibility to make the determination as to the
eligibility for coverage under this warranty.

No
claim will be recognized unless submitted on a “FOREVER” ORT
Request for Warranty consideration for (to be supplied by a
“FOREVER” dealer). This form must be completely and accurately
filled out and signed by you, the owner or authorized agent, for the
tyre presented for adjustment.

The
vehicle and / or site on which the tyre (s) was /were mounted must be
available for inspection upon request.
-
You
are responsible for payment of all applicable taxes and charges
incurred during replacement or repair of tyres including dismounting
mounting and balancing you are also responsible for payment for the
tyre rotation, alignment, towing road service, liquid ballast, valve
stem, or any parts or service ordered regardless of months in services

ADJUSTMENT POLICY
FOR “FOREVER” OFF THE-ROAD BIAS TYRES
This Limited Warranty and Policy is a promise of
replacement under certain specified conditions. It applies to tyres in
normal off highway services displaying adjustable conditions (see :What is
Not Covered”) and does not require the existence of workmanship or
materials in order to qualify. THIS POLICY IS NOT A WARRANTY THAT YOUR
TYRE WILL NOT FIAL OR BECOME
UN SERVICES ABLE IF NEGLECTED OR MISTREATED.
DEFINITION
Off-The-Road tyres are defined as tyres whose principal
application is for specialished service in other than normal highway
operation and which do not bear a mark indicating that they are for
highway used under local law. It doest not include, among others,
agricultural tyres, aircraft, light construction tyres, or tyres marked
“NA” (not adjustable).
ELIGIBILITY
This Limited Warranty and Policy applies to the owner/user
of “FOREVER” brand off-The-Road tyres bearing our name and serial
numbers used in normal off-the-highway service. This Limited Warranty and
Policy applies to the original purchaser, and it assignable up to the
first end-user. The warranty covers for any location in the world except
of Arctic applications (within Arctic/Antarctic circle) Tyres marked as
“NA”, “USED”, X”d by serial number, cut above or below the
serial number or serial number cut out are not eligible for any warranty
consideration.
COVERAGE
Every OTR tyre bearing the name “FOREVER” and with a
complete serial number moulded in the sidewall is warranted to be free
form defective conditions within the manufacturer’s control. If an
examination by an authorised “FOREVER” representative shows that any
such tyre failed as a result of a condition under the control of the
manufacturer, it will, at the option of “FOREVER” either be repaired
at no charge, or replaced with a new “FOREVER” product on a pro-rata
basis for the unused tread life. This credit will be determined by
applying the percentage of remaining tread depth (RTD%) to the following
chart. The percentage credit noted on the chart will be multiplied by the
dealer’s original purchase price of the tyre (excluding all taxes) to
determine the amount of credit to be applied. Such credit must be applied
toward the purchase price in effect at the time of adjustment of a new
“FOREVER” OTR tyre.
Service
related charges and applicable federal, state and local taxes are not
covered by this Limited Warranty and Policy. This warranty coverage is for
OTR tyres used within published designed specifications for “FOREVER”
tyres. Any use outside such specifications automatically voids this
warranty. Please consult “FOREVER” data sheets, maintenance manuals,
etc for design specifications. This warranty does not apply to used or
“NA” (not adjustable) tyres.

warranty applies to “FOREVER” OTR tyres for a period of one year from
date of manufacture. The date of manufacture can be determined by the last
3 digits in the serial number code
